The HR departments or the hiring managers are doing it wrong if there is EVER a hiring decision to pick anyone other than the most qualified. AA does not require hiring less than the most qualified person.

Many college policies select students on criteria that does require them to choose a less qualified candidate if he is black. This is documented. I would argue that many employers have similar policies, if nothing else just to avoid getting sued or worse, labeled "racist" for no cause.

That is, after all, what you Democrats love to do. Your intimidation tactics go back to your KKK days.
 
Any employer is free to hire the occasional less than best qualified black man in order to avoid developing a hiring policy that is objective, comprehensive, and thorough. That's on them, however, and not on AA.

Unless, of ourse, managers like you place hidden qualifications on jobs such as, they gotta be white like me. THEN, hiring the most qualified is illegal.
For my employees it's show up on time and steal less than $50. A shift.
