I've also pointed out the error of your argument. NPDES doesn't apply to spill situation. You're approach is an impractical and unworkable suggestion and the 15 ppm TPH CWA limit is a strawman. If that were the case they wouldnt' be burning the shit.
NPDES applies to the discharge of the water during the skimming process. It doesn't apply to burning since they don't discharge water. Good thing the air regulations don't apply or this technique couldn't be used either.
