Judge blocks parts of Arizona immigration law

I reject that notion to. Not being a citizen should not be a crime. Should it mean that such an individual who does not have citizenship or legal residency status should be removed? Yes it shoud but criminalizing them would be a big mistake.

As for the law. A law doesn't have to explicitly identify and marginalize a racial minority to be racist, as I've demonstrated.

Why shouldn't it be a crime??

What part of illegal don't you understand??

By your reasoning, Bank robbery is a racist law; because more whites are arrested for Bank robbery, then any other group.

The law makes it CLEAR when a person can be questioned about their legal status: You quoted the un amended version.

amended version here

"For any lawful contact STOP, DETENTION OR ARREST made by a law
enforcement official or a law enforcement agency of this state or a law
enforcement official or a law enforcement agency of a county, city, town or
other political subdivision of this state IN THE ENFORCEMENT OF ANY OTHER LAW OR ORDINANCE OF A COUNTY, CITY OR TOWN OR THIS STATE where reasonable suspicion exists that the person is an alien who AND is unlawfully present in the United States, a reasonable attempt shall be made, when practicable, to determine the immigration status of the person, except if the determination may hinder or obstruct an investigation."

Please note that "reasonable suspicion" is in the amended version.

If I am pulled over and only have my New Mexico license I must provide a second form of ID under the Arizona law. This is because NM has decided it is better than everyone that drives has a license and can therefore get insurance. So illegal aliens can get a license and then get insurance. That means I have to use a second form of ID.

On this, I'm calling BS; unless you can show that you came to AZ, was pulled over, and had to provide a second form of ID.
Otherwise it's just conjecture and fear mongering.

Are you attempting to insult me because you realize that SB 1070 allowed racial profiling?

No, I am laughing at you because you are offended by Quick Draw McGraw. And if you are offended by that, you are sensitive enough to be offended by virtually any mention of hispanics or latin americans that is not total praise.

Not under the provisions of SB 1070. For example, a New Mexico driver's license would not be accepted as proof of citizenship or legal immigration status.

What the law says

Here's what the text of SB 1070 says:

A PERSON IS PRESUMED TO NOT BE AN ALIEN WHO IS UNLAWFULLY PRESENT IN THE UNITED STATES IF THE PERSON PROVIDES TO THE LAW ENFORCEMENT OFFICER OR AGENCY ANY OF THE FOLLOWING:

1. A VALID ARIZONA DRIVER LICENSE.

2. A VALID ARIZONA NONOPERATING IDENTIFICATION LICENSE.

3. A VALID TRIBAL ENROLLMENT CARD OR OTHER FORM OF TRIBAL IDENTIFICATION.

4. IF THE ENTITY REQUIRES PROOF OF LEGAL PRESENCE IN THE UNITED STATES BEFORE ISSUANCE, ANY VALID UNITED STATES FEDERAL, STATE OR LOCAL GOVERNMENT ISSUED IDENTIFICATION.

You are incorrect regarding New Mexico driver's licenses, which is what I stated. They are not accepted as proof of legal residency, immigration status, or citizenship.

Funny how Conservatives only care about the constitution when it is there issue, then they pretend to be all richous about it.

"On the much-discussed issue of whether the law permits or encourages "racial profiling," we find:

• The amended law allows police to consider "race, color or national origin" when deciding whether to ask somebody for proof of citizenship, but only to the extent already deemed constitutional by the courts.
• It remains to be seen how police will interpret the law’s anti-profiling language in practice. State officials tell us they have yet to work out what factors police should be trained to use to establish "reasonable suspicion" of illegal status."

If the person being questioned, has no viable connection to the incident, then that's as far as it goes.

Would you do everyone and yourself a favor and actually read SB 1070.

Incorrect.

"Though the law only allows officials to ask for proof of citizenship in the case of "legal stop, detention or arrest," this doesn’t limit the questioning to suspected criminals — it can include those who are detained as victims of or witnesses to a crime, or people accused of violating local ordinances like noise laws or loitering laws. Roman is concerned that police will be more likely to both stop and to question those who they think look like immigrants. "The legislature was pretty careful in following criminal procedure notions, but it’s the discretion in how the law enforcement will use criminal procedure [that] is how the racial profiling comes into play," he said."

I have not insulted you, why insult me?

You have no basis for interpreting motivation in discusssing this issue. If you are unable to debate without using ad hominem attacks, then perhaps you should refrain from engaging in this topic.

Again: "FOR ANY LAWFUL CONTACT MADE BY A LAW ENFORCEMENT OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE WHERE REASONABLE SUSPICION EXISTS THAT THE PERSON IS AN ALIEN WHO IS UNLAWFULLY PRESENT IN THE UNITED STATES, A REASONABLE ATTEMPT SHALL BE MADE, WHEN PRACTICABLE, TO DETERMINE THE IMMIGRATION STATUS OF THE PERSON. THE PERSON'S IMMIGRATION STATUS SHALL BE VERIFIED..."

The issue lies in the interpretation of "reasonable suspicion".

It has already been determined that it is violation, to stop someone with the intent of determining their legal status.
The PRESUMPTION is not resonable.

Why are you misrepresenting this, unless it's just to see how much controversy you can stir up?

A resident alien may get a NM drivers license if they have a metricular number issued in state...meaning that they will have to show the US Consular that they are in the state of NM legally!!!! This means that if they have a current NM drivers license that it can be assumed by law enforcement that they are here legally!!!

To get a NM drivers license you must provide:

MVD Proof of Identification Number

MVD Proof of Identity

Proof of New Mexico Residency

If you are not eligible for a social security number, you will need to bring the following documents to any MVD Field Office:

- One (1) proof of Identification number - No SSN, and
- One (1) proof of identity - No SSN, and
- Two (2) proofs of New Mexico residency

At least one of the ‘proof of identity’ or ‘proof of identification number’ documents must also show your date of birth.

If you are a foreign national applying for a first time license at a State field office, you must make an appointment. No exceptions. Walk in's will be referred to the website or told to call the MVD appointment line. Click here to make an appointment

From the AZ state website: law enforcement officers may only inquire about immigration status if there is first a lawful stop, detention or arrest for a violation of some other law, and then the officer has reasonable suspicion that that you are an alien unlawfully present in the United States. If this occurs, the legislation provides that any one of the following forms of identification will be accepted by law enforcement as proof of legal immigration status in the United States:

A valid Arizona driver license.
A valid tribal enrollment card or other form of tribal identification.
A valid Arizona non-operating identification license.
Any valid United States federal, state or local government issued identification, provided the entity requires proof of legal presence in the United States before issuance*.
The federal government, or a state or local law enforcement officer authorized by the federal government, can only make the final determination of a person’s immigration status. State or local law enforcement officers who are not authorized by the federal government cannot make these determinations.

* If you question the validity of your state’s form of identification, please refer to your state’s Motor Vehicle Division
