In America there are many thousands of defensive gun uses every year where no shot is ever fired even with Cops. The very appearance of the gun frightened the criminal into breaking off the assault and RUNNING . So they pulled a gun and WERE prepared to use it, they just determined that it was not necessary in the final analysis. In effect they pulled their gun to scare the criminal or tresspassers off and it worked.

While I respect your answer it is really not a struggle at all. An unarmed person does not justify the use of deadly force. Particularly when they are not within your personal threat zone. And shooting without warning is not accepted by any law in this country. Except for congress apparently.

I don't think you can make a blanket statement it's never justified to kill an unarmed person. There's too much gray area and situations where it would be justified. If a suspect attacks an officer, are we expecting the officer to get into a fist fight, risk being knocked unconscious and having the unarmed suspect use his gun against him?

I try to put myself in the situation of the cop in this case. If a clearly angry, violent man/woman was bashing in the front window of my house, should I be able to use lethal force to protect those inside? Should I let them come in through the window, engage in a physical alternation with him/her and hope that I can beat them? Should I call for help and hope that it arrives before they potentially pull a gun or guns from their backpack and use it on me or others inside?

If it was your kid's school (I have no idea if you have kids) and someone was bashing in windows to get into the school, would you want the officer to let them in?

The attack began at 1PM and Babbit was shot as 3:11PM. That's over two hours for the mentally impaired.

They break windows and try to force their way in.

Her shooting wasn't justified because the conditions when she was shot didn't meet federal use of deadly force guidelines. The officer could have come out of that side room or hallway, announced his presence, and confronted her. He did none of that. He didn't shout a warning at her, nada, zip point shit. He fired on her immediately.

That's in total contradiction to federal use of force guidelines. The officer was completely wrong and totally fucked up shooting her.

Look at the half-dozen or so officers on the other side of that door mixed in with the mob. Not one of them drew their weapon. They were dealing with the rioters by physical presence and verbal commands alone. The jackass that shot Babbitt could have done the same, but being a repeat fuck up, he did the wrong thing and shot her.

What makes his offense so much worse is, after he shot her, he fled the scene. Explain that away.
Indeed he was a coward that was too afraid to arrest a 100lb 5'0" tall woman. He murdered her and ran away.

Let's not forget, it wasn't just a single, crazed woman. She was the lead of a mob who were going to follow her through, just as they did from the outside barricades for the previous two hours.

The mob was a weapon. Shooting Babbitt stopped them in their tracks because none of the idiots behind her wanted to get shot.

How difficult is this to understand? Ashli Babbit was the only person of the mob that was entering the locked hallway which contained the offices of Congressional members by climbing through a window. Ashli Babbit is the only person that was shot. Pretending facts don't exist doesn't make them go away.
The mob was yelling threats against members of Congress.
The mob was breaking windows that prevented them from getting to members of Congress
When one of the mob attempted to go through one of the broken windows allowing them to possibly attack members of Congress a member of the police whose job it was to protect members of Congress shot them.

While you may not like it that she was shot, the likelihood of convicting that officer in a court of law is pretty slim. The problem you have on this message board is you are not looking at all the facts and being very selective in which ones you think matter. That's not the way the law works.
