My read on it is that Rock is sitting back and staying out of the way because there are a few different things going on, both legal and with the Academy.

Some here have made a big deal about Rock not pressing charges, but doesn't he still have that option at any time for awhile?

The Academy of Motion Pictures Arts and Sciences on Wednesday said that Will Smith was asked to leave Sunday’s Oscar ceremony after hitting Chris Rock but refused to do so.

The academy’s board of governors met Wednesday to initiate disciplinary proceedings against Smith for violations against the group’s standards of conduct. The academy said disciplinary action for Smith could include suspension, expulsion or other sanctions.

Many have focused on why Smith was allowed to remain seated front row in the Dolby Theatre after the incident. On Wednesday, the academy suggested that it attempted to remove the actor from the audience.

“Things unfolded in a way we could not have anticipated,” the academy said. “While we would like to clarify that Mr. Smith was asked to leave the ceremony and refused, we also recognize we could have handled the situation differently.”

A representative for the academy declined to give specifics on how it tried to removed Smith. After Smith struck Rock in response to a joke about his wife, Jada Pinkett Smith, several stars including Denzel Washington, Bradley Cooper and Tyler Perry spoke with the 53-year-old Smith.

I was kind of ticked at people defending it today. He's not a "man" for standing up on behalf of his wife. That was pathetic.

Do you think it may have been staged? They need to feel relevant, the Oscars themselves used to be enough as folks would watch it, nowadays, only their mothers watch it, and then they watch a replay so they can skip all the rest of those idiots to get to their own kid.

Will Smith has issued an apology for striking presenter Chris Rock at Sunday’s Academy Awards.

In a post on Instagram on Monday afternoon, Smith called his behavior “unacceptable and inexcusable.”

“Jokes at my expense are a part of the job, but a joke about Jada’s medical condition was too much for me to bear and I reacted emotionally,” he wrote. “I would like to publicly apologize to you, Chris. I was out of line and I was wrong. I am embarrassed and my actions were not indicative of the man I want to be. There is no place for violence in a world of love and kindness.”

Smith added in his post that, “Violence in all forms is poisonous and destructive.”

He also included in his note an apology to “the Academy, the producers of the show, all the attendees and everyone watching around the world,” as well as the family of tennis stars Venus and Serena Williams and those involved with the film for which he won his best actor award on Sunday.

“I deeply regret that my behavior has stained what has been an otherwise gorgeous journey for all of us,” he wrote. “I am a work in progress.”

He needs to tried for assault, otherwise he's above the law.
 
Agreed....and Rock filing a complaint to a recorded assault isn't a requirement for justice to be done.

The State Attorney can choose to file a simple assault charge although it wouldn't accomplish much.

The penalty would be so light it would serve no real purpose other than to make a point.

Nevertheless, it should be done since, not to do so, reeks of privilege and special rights for the Rich and Famous.

Let Smith plead guilty, take his community service and pay his fine. Let justice be done.
 
A complaint would energize the law. Without it, the cops look like they are nosing into personal problems.

Are you saying that if a cop witnessed a bank robbery himself but the bank didn't press charges, that nothing would be done?

Again, not a fucking lawyer, but it seems to me that there are two things going on here:
1) the law and those sworn to uphold it.
2) witnesses to a crime.

If the bank was robbed and there are no witnesses to testify to the crime, that's a huge problem in winning a case against the criminals.
OTOH, if a cop was the witness, not only does he have a duty to uphold the law, as a witness he can testify for the court.

The whole world, including a shitload of live witnesses saw this crime. While witnesses are reluctant to "get involved", once subpoenaed and put onto the stand, the odds are they'll tell the truth.

In the end, legally, I'm guessing that Will pleads guilty through his lawyer, pays a fine and does community service talking to kids about domestic violence and how "poisonous beotches be bad".

What the Academy does to him will cost him a lot more.

Assault is considered a crime against the public.
 

..and I'm pretty certain that's exactly what will happen unless Smith goes wild one night and shoots the poisonous witch to break her evil spell. LOL

My guess is that Smith is going to have greater repercussions from the Academy upon his career.

I can suggest that I will get up and fake slap you before the show started, crap I can do it in the head just before you go on stage... Pretending they couldn't stage this is just silly.

They could have staged it, but I don't believe they did.

smiths anger was real.
