There is a big difference between "Hang Mike Pence" and "I am going to hang Mike Pence" for purposes of prosecuting a threat.

I understand. My point was that chanting "Hang Mike Pence" does not constitute a threat. Nobody threatened to hang him. They were just advocating that it be done or it was a way to express opposition to his actions. If they were really intending to do it someone would have to say "I'm going to kill Mike Pence." A specific person has to threaten a specific person with a specific act.
Nazis could chant "Kill all Jews." The KKK could chant "Kill all Blacks." Communists could chant "Overthrow the U. S. government with violent revolution." None of those are criminal threats.

Typical for the right wing to use the Clinton defense of "It depends on what is is". If I threaten to hang someone, build a gallows, and then run around with a rope to hang him with, that is a threat.
