The legal claim is that James' and her family did not live there. If her dependent family lived there, that is just as good as her living there. Now we have them proving that her dependent family lived there, destroying their own case.
 
Judge Jamal Walker has decided that he is going to grant a request by James' attorneys to have her motion essentially to disqualify Lindsey Halligan on the grounds that she was not lawfully appointed consolidated with that of Jim Comey, who also brought a similar motion..

They are going to be referred to the chief judge of the Fourth Circuit of the US Court of Appeals for assignment to someone outside the Eastern District of Virginia.
 
I will say that James got lucky in that she has a Biden appointed judge with his being rejected by the Senate committee on judicial nominations the first time around and appointed on a 52-39 vote which doesn't speak well of a judicial nominee. That her judge is both Black and marginally competent works in her favor.
