Charging a child who probably still believes in Santa Claus and the Tooth Fairy with a crime is probably counterproductive. The mother should be charged with a crime, though, for making a loaded gun accessible to a six-year-old and then never noticing that he packed it into his backpack, went to school, pulled it out, and deliberately shot his teacher with it. The child also needs immediate psychiatric intervention. He is likely to shoot someone else, and next time might result in a death.
