Whether the bank falls for it or not doesn't matter when it comes to bank fraud. It's like arguing you didn't commit a crime if the teller doesn't give you money during a bank robbery. The crime still exists in both cases.

The bank fraud is more likely to be charged in my opinion. But it ends up being a lot more complicated than that. It isn't uncommon for a tax appraisal to be 20% off from a bank appraisal so simply have different values isn't always an issue.

It appears there are 3 different times that Trump set the price of his properties for transactions.
He argued they were lower in order to reduce property taxes.
He argued they were higher to take out loans
He also argued the value was higher when he donated the property as a tax write off.

One of the questions is going to be who did the appraisals, were the appraisers corrupted in some fashion, and how and when were the different appraisals used for Trump's advantage.

I don't think you get it. Lying (undervaluing is considered "lying") about the value of your property in order to lessen the taxes you owe on your property is a crime. That is what the NYS and NYC AGs' offices are investigating. I doubt if they care what the lenders lent out or whether they're receiving timely payments. Their only legal interest is in discovering whether the Toadstool Crime Syndicate evaded paying what they legally owe.

We won't know until the investigation is done. My guess is the minimum is going to be a civil filing for taxes that were not paid. Whether it rises to criminal tax evasion or bank fraud we won't know until the investigation is done. What we do know at this point is there is enough evidence to support at least a hard look at the legality of the actions taken by the Trump organization. The problem with the legal case is much of the legal jeopardy requires showing intent. Trump can always claim stupidity as a defense and it would be hard for the prosecution to prove he isn't stupid. (Other than playing the clips of him claiming to be the smartest person ever but that would just be hearsay.)

Actually he reminds me of Hillary. Really leaves himself open for scrutiny but never really goes anywhere
