Yes. Refusal to comply with the FBI is the issue, but he kept documents in the desk he used on a daily basis. He knew what he had, and he knew he shouldn't have them.There is no proof that Trump stole or intended to steal documents. It would be impossible to prove that in court unless you have evidence that Trump personally packed every box that left the White House.
Where intent becomes easier to prove is when he didn't return them when asked. That is Trump's legal peril.

The law regarding classified documents requires more than just possession. It requires intent. Failing to turn over when asked would imply intent. Turning over the minute they are found and claiming an accident makes it hard to prove intent.
Trump's biggest problem is his refusal to comply with a subpoena asking for the documents and possibly ordering someone to move them so they wouldn't be found during a search. If Trump had turned them over when asked there would be no legal peril for him.
Garland will indeed move on trump. If for nothing else, the theft of classified documents and lying to the FBI about returning same.
We still have to find out who trump sold the classified information to, besides Saudi Arabia.

In Trump’s case, the States will be taking him on and, probably, down. Although I doubt Trump will ever spend a night in prison, I believe the price for his crimes will be the loss of TrumpCo. He’ll be reduced to his residence at Mar-a-Lago and everything outside his doors will be owned by others.
