He does not have the right to tell Flynn to ask Russians to hold back on a reaction to sanctions... which is what Flynn is saying. Remember they likely have audio of these calls. That would be a crime.

Yes he was technically still a private citizen, but at the same time he was a part of the incoming elected administration. You are trying to split hairs. There is a reason we haven't seen anyone prosecuted the Logan act in over 100 years.

So a law is not valid unless someone is prosecuted for it or convicted... Wow, Ill add that to my closing arguments, I wish they had taught me that in law school!
