The 14th stipulates that party is not the basis of criminal law. Two men, Obama and Trump - engage in identical acts - one is prosecuted, the other is a democrat.
not even close to identical. Pence and Biden were identical acts

Trump had no right to possess top secret documents after he left the office of President.
An utterly false statement.
This was written Obama era - so it hasn't be altered yet.

Since then, archivists have gathered artifacts of historic importance, including hundreds of millions of textual, electronic, and audiovisual records, and tens of thousands of presidential gifts. Now they’re packing the final boxes, which will be moved to a temporary facility near the future site of President Obama’s library in Chicago.
NARA has been involved with moving presidential artifacts of record since 1939, when Franklin Delano Roosevelt gifted Congress his presidential papers and historical material to open his presidential library in New York. In 1955, Congress passed the Presidential Libraries Act, which officially established a system of privately created and federally maintained libraries. But the original act had a flaw—it didn’t require that a president had to donate official papers to the Archives. That meant that there was nothing stopping a former president from deciding not to give up certain papers. That issue came to a head in 1974, when Richard Nixon resisted handing over some 3,700 hours of tape}

So once again youre telling me if they found classified documents in one of trumps old office closets or the garage at his home you would tell me, "Simple existence of documents in a location does not show that anyone knows they are in that location or than anyone knows they are classified or who put them there."
Why do you think everyone is as stupid as you are?
Trump wasn't indicted for sharing classified information but the indictment does state he did share that information.
Edited to add US 18 793(e) which Trump was charged with 31 counts on.

(e) Whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it; or
My dear it’s nice that you continue your total bullshit. You gotta ask yourself why did he take them and why didn’t he just return them?
not even close to identical. Pence and Biden were identical acts
I would expect an investigation would be done, kinda like they’re doing in the Biden case, and they did in the Pence case. If that investigation showed evidence as to how those documents got there, or that someone specific knew they were there and knew they were classified, and did not turn them in, then I would expect charges to be filed.
Fucking bullshit.
Obama is not Pence. Try again.
Brilliant argument.
No, I played your game a little while, so I wish you would answer my questions.
It appears you agree that Trump is charged with very serious crimes. If they prove the allegations, do you think he has a defense?
The only appropriate response to bullshit is to call it what it is. As to your question yes there is ALWAYS a defense. The problem is you don't like it. That's not the same as there is no defense. It's just like evidence that trump raped the gold digging whore like you told me. Why do you think everyone is as stupid as you are?
The US only has one CiC at a time. Former CiC's are no longer the CiC. Former CiC's have no right to retain classified documents in their home unless authorized to do so by the current CiC.
Idiots seem to be where you live.
What is the defense?
I have no idea which is not the same as saying there isn't one. I'm not a lawyer, thank God!!!!!!!!!
Number of documents Trump showed to people that didn't have security clearance - at least 2 are included in the indictment.
Haha ok, you are just sure there is one. I understand.
Is this something Trump should be prosecuted for?
OK, well if there is evidence to suggest he knew those documents were there and that they were classified for those years and he did not call the FBI or the justice department to return them, then I think when he’s done being president, if the statute of limitations is not over, he should be prosecuted. Even if that is the case, I still maintain that it’s nothing compared to what the evidence, says Trump did.
And had trump done what Brandon did you'd be demanding an indictment. Deny it bitch
