Cops and schools had no duty to shield students in Parkland shooting, says judge

I said the cops, not the FBI. You have a dangerous suspect at large, it is definitely the cops job to deal with them. You know that, because they tell the people not to try to handle anything, it's too dangerous. You leave it to the police.

They have no obligation to do anything. Again, tons of court precedents say as much. None say the contrary.

Watch for the huge ass settlements, pally boy. The cops and the school district don’t want any of these suits in front of a jury.

This was one case among many and only based narrowly on the 14th Amendment.

It can't be brought before a jury because there is no standing to do so. It's been decided time and again over the last 30 years, the police have no obligation to do anything. And so what if they do settle? They have insurance for that.

Socialism pays for that insurance.

As parents of the deceased, they very much have standing. Civil law is full of those kinds of cases.

This case was a 14th Amendment, due process decision, not one based on misfeasance, nonfeasance or even wrongful death. The same day, another judge ruled oppositely.

Pay attention to the reasonable man standard. Deaths caused by negligence, which the task force is concluding, is going to cost. Big time.

“And so what.....”? What a fucking douchenozzle.

Castle Rock v. Gonzales, 545 U.S. 748 (2005),[1] is a United States Supreme Court case in which the Court ruled, 7–2, that a town and its police department could not be sued under 42 U.S.C. § 1983 for failing to enforce a restraining order, which had led to the murder of a woman's three children by her estranged husband.

This is also a 14th Amendment case, because it says you do not have a right to police protection. That's the exact same fucking thing in both cases. Read more than nothing at all for once in your life.

Watch, pally boy. Maybe not all, but many of these lawsuits will make it to civil trial, or more likely a settlement, and not on any Due Process bullshit. They will make it through on negligence, nonfeasance or misfeseance. On the part of the FBI, the school district and the local police. And has nothing to do with due process. It has everything to do with lack of training, lack of protocol, lack of physical controls

Why a settlement? Because none of those entities want this to go to a jury.

And, BTW, this negligence case is going forward.

Take it to the bank, pally.

They can't be held negligent for duties that are not required of them. Civil proceedings won't survive summary judgement.

Yeah, that “Protect and Serve” is just concocted bullshit, isn’t it.

Fucking moron.

Awwww just because it says it on a car you think it is legally binding. How cute

No policeman is under any obligation to sacrifice his life for you. In your case they would let you be shot and call it a public service.

I bet domer believes "Neither snow nor rain nor heat nor gloom of night stays these couriers from the swift completion of their appointed rounds" is the official motto of the postal service.

protecting is not the same as sacrificing your life for them

how can they protect people if they walk into sure death?

Inaction when multiple murders are in progress is just a tad different than not enforcing a restraining order.

Take this one to the bank, pally

If you had been paying attention, dumbfuck, the police are not the only ones at fault here.

When the maintenance crew mops the floor, doesn’t place a “Wet Floor” sign, someone slips and injures themself, who is negilgent and loses in a lawsuit?

There was negligence on the part of the FBI, which they have already admitted. The school district had inadequate training, lack of protocols and inadequate physical controls.

Pay attention when the money starts to roll in.
