There are numerous differences in the constitutional rights that you and I enjoy, and those enjoyed by those in the military.

The 1st Amendment does not apply to active duty members of the military. There is no freedom of speech or right to assemble.

The 4th Amendment protects us from unreasonable search & siezure, but military personnel can be searched anytime they are on base or ship.

The 8th Amendment would certainly prohibit restricting someone to 3 days on bread & water, but the military can still do that.
While there is no precedent for what I'm about to say, were it presented, it would certainly win.

Article 6, section 1, paragraph 2:"This constitution, and the laws of the United States, which shall be made in the pursuance thereof: and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land".

Basically it says the Constitution is the highest law. The UCMJ, the governing law for the military (United States Code, Article 10, Chapter 47), derives it's authority from the constitution (via Article 1, Section 8). Thus it cannot deny rights that congress has no right to deny.

true...and unless there is a draft, it is by choice...you bring up a good point

as to the last...i would imagine that would be found to violate the 8th if an inmate were to bring such a case...
 
Anyone ever consider the legal argument that the draft violates the involuntary servitude clause of the 13th? Obviously it did not yet exist during the Civil War, but we have used it since in WWI, WWII, Korea, and Vietnam...

no...because the government is not a servitude owner...you are owned by the government and its legal, because the government says so....:clink:

I signed an enlistment contract at 18 :)

As for the selective service registration, I was merely following the law, and not my heart.
