Why Trump's Legal team will not even be able to assert his main defense.

I have been saying this for weeks now and i see now that many lawyers on TV including very conservative lawyers, are all coming to the same conclusion.

Trump won't take the stand. It would be a dream for the Prosecution to have him do so as they would end up with 10 additional perjury charges and a slam dunk verdict on this case as Trumps own words ('She is not my type'... 'that's Marla') hung him.

And if he does not take the stand there is no way for his legal team to enter his defense on his belief that he 'had a right to do this'. It would be hearsay for anyone, including Trumps lawyers to say 'this is what he believed'. Only Trump can express that and try to get a jury to believe him.

It is a terrible defense regardless, but it seems to be the one Trump has painted his legal in to, and yet they cannot introduce it without him taking the stand.

i hope, beyond hope, his ego gets the best of him and he demands to his legal team to take the stand when they explain to Trump the only way they can make those arguments is if Trump takes the stand and asserts his beliefs. We might actually see Trump bumped to a Treason verdict if he does that and sentenced to death. That would be hyperbole, if it was anyone but Trump.

I'll be pleasantly surprised if the defense is even forced to present a case.

I expect a summary dismissal after the prosecution presents its evidence.

There is no legal statute they can present to show what Trump BELIEVED.

Trump must present his mindset or beliefs himself if his case is pinned on him not having 'intent' and thus not being guilty.


If instead his legal team simply wants to argue that the PRA says 'ABC' when it does not, firstly a judge would likely deny that (you cannot go into court and argue the murder statute says i can kill anyone, when it does not) and even if with a bad judge it was allowed to be argued that would be a laughably terrible position without being able to introduce Trumps beliefs as they apply to intent.


No one can introduce what Trump believed and intended but Trump.

Doesn’t matter what Trump believes it matters what the law says

The DOJ already argued this case under Clinton and proved that the president has the right to keep any documents he wants and the judge agreed

They can’t argue the opposite now when no laws have been changed

Why would it be fair for one president to keep them but illegal for another?

The PRA does say the president decides what's a private record and what's a presidential record. A reasonable person can assume then that trump believed he could decide that.

BTW have you ever sat on a jury in an actual case?

WRONG in two ways.


While the way the law is written matters and that is Trumps worst defense, what Trump has been arguing is an 'intent' defense. Intent defenses are pinned on what you BELIEVE, and not necessarily what the law strictly says.

It is entirely possible in most white collar crimes, to break the law in a factual and provable way but to not be guilty if you did not have any intent to do so or the prosecutor cannot prove intent.

Trump's lawyers cannot introduce any elements of an 'intent defense' if Trump does not take the stand.


And it will be a very short trial if they are choosing to not introduce any 'intent' defense and they want to pin the entire case on a 'technical reading' of the law as you will not even find a Trump lawyer currently who is arguing Trump is correct on the technical reading of the law. All of them speaking on tv speak to his belief and intent as they know the technical reading does not apply.

The very fact they were taken to Mar A Lago means the President deemed them to be declassified because he deemed them to be his personal Presidential documents.

NO they cannot in a Court of law just have 'every reasonable person' in the jury make their own assumptions what Trump believed.

No they cannot allow Trumps own lawyers to present what he believed as a reasonable person.

Trump has to present his beliefs and tell them 'this is what i believed' for that to be an item for them to consider.

Hearsay and assumptions do not get presented in court.
