Under the US constitution, nobody is hung for treason without due process in-which general Lee and the confederacy never got.
The confederacy was never tried and convicted of treason in court.
If the government charges me with treason and throws me in jail then I demand due process. I want to be charged with the crime by a judge and I want a lawyer standing next to me ready to defend my constitutional rights.
Jefferson Davis, the president of the confederacy, General Robert E. Lee and the rest of the confederacy were all never given due process and their day in court.
Lee was not tried because Grant alone, who had enormous influence in Washington, got him off.
All of congress and Johnson were more than prepared to convict Lee for treason and see him hung.
