At least for now. I love that his defense attorney "accidentally" sent all his text messages to the prosecution. And now the J6 Committee has them.

In a criminal case there are very few incidents where you have to participate, due to your right against self-incrimination. It’s different in a civil case, the court can require you to provide documents and depositions, And if you refuse the court can impose sanctions, sanctions that go as far as directing the verdict against you, without a jury.

I would be surprised if this Jones character is not prosecuted for perjury after his most recent testimony on the stand. He blatantly lied several times. The judge pointed out that he lied several times. I’m sure there is a prosecutor drawing up charges as we speak.

In this case, parents of the dead children told them, teachers and other school officials told them, journalists who covered the event told them, their own minds having taken it all in and if not programmed like a robot, told them.

Good point. I would not be happy about it.

It is hard to prove ineffective counsel. One lawyer fell asleep during the trial and the appeals court ruled it was not a problem because nothing significant happened during the nap he could have objected to.

When I was teaching I used as an example a man whose murder was overturned because during the trial his lawyer began an affair with the defendant's wife and they came to court and held hands. Later, I discovered my memory was faulty. The conviction was overturned because a member of the grand jury was not a resident of the county. The lawyer/wife was not an issue.

It was not a criminal trial. People are not found guilty in a civil case. He defaulted and was found liable for defaming families who spent years being threatened.

I wonder if all those who believed nobody died in those shootings because they believed Jones now believe him when he says it is 100% true that children died?

All the Bill of Rights applied only to the federal government before the incorporation process (1925-2010) when most rights were made applicable to the states. This is basic constitutional law.

The 7th amendment right to jury trial in civil cases is one of the few rights that does not apply to the states.

This is a non issue since Texas allows jury trials in civil cases and a jury determined his penalty.

You still generally have a right to a trial in a civil case, its not an absolute right.

Jones was not punished for questioning what the government told us. Government did not sue him. Free speech/press does not allow us to defame people if it is false and causes harm.

A majority of the country did not believe the government's claim that Biden won the election only because of voter fraud.

That is my understanding also. The 7th only guarantees it in federal cases and federal law determines the types of cases it applies to.

The 7th does not guarantee a jury trial in civil cases in state courts but most states provide this option.

The Constitution does not make "exceptions" for a jury trial, but neither does it contain any details about federal court procedure--that is a power made by the courts and Congress. The Constitution grants power to make those decisions, it does not contain the procedures in the document.

How do you reconcile that with the 7th amendment.? It says in civil cases involving over $20 you have right to a jury trial. The 7A makes no exceptions.

You stupid jackass. Defendants are found guilty in civil cases all the time. They cannot be sent to prison but they have to pay damages. You are playing with words. If you would rather say "he lost the case" that is the same thing and is fine. THINK
