What's the story with floyd?

If they are part of a conspiracy to murder, they are guilty of murder. If they were part of the conspiracy at the beginning, and then did not do a positive action to get out of the conspiracy, they are guilty. The park police officer has a good defense. The three police officers that were in the immediate area assisting Chauvin are legally screwed.

To get it down from murder, you have to prove that choking could not foreseeably cause death. Choking does cause death, so that is a tall order.

you do realize just because someone causes the death of another, it's not always murder 1, right? why do you think we have manslaughter on the books? this is not fantasy world - our laws have actual definitions. murder 1 is intent to kill with lying in wait. no DA could prove that. 2nd could POSSIBLY be proved, but it would be a stretch. manslaughter is negligent homocide. a reasonable jury will believe he did not intend to kill the man but acted recklessly.

His right carotid artery was occluded by the knee and the left carotid artery was occluded by the concrete pavement and the cop's weight. That deprived his brain of blood and that killed him. The cop knelled on his neck for over 8 minutes. When he said he could not breath. In fact he could breath because you have to breath to be able to talk. The neck has carotid bodies that help regulate the blood pressure some people have overly sensitive carotid bodies. I had a patient that got dizzy when he shaved. We hooked him up to a EKG and massaged his carotid on one side of his neck. His heart beat stopped for 45 to 50 seconds. (scared the crap out of me) I told him to grow a beard:laugh: and sent him for a pacemaker.

Yes, I'd say 1st. and 2nd. deg murder is out. 3rd is a good possibility, which carries a maximum of 25 years.

As for a trial, I'd also say a jury trial is out (a jury will hang them). If it goes to court, it will be under a judge.
I'd say they will try to plead it out to a lesser charge like manslaughter hoping (and which often happens) a judge is more lenient in sentencing.

Why couldn't that cop have used the lower part of the leg nearer the knee to pin down the suspect?

From what I've read, apparently even bystanders were yelling at the cop, yet he and his fellow officers paid no attention.
Even Houdini himself couldn't get out of a pair of handcuffs lying on his stomach and get away from 4 cops standing over him.

Anything that compresses the carotid can be dangerous. I suspect the cop was teaching Floyd a "lesson" by grinding his face into the pavement. The cop is an asshole and now a murder and needs to be in jail. He had reckless disregard for Floyd's life.

It was a team act moron.....

The UK police use the same technique but not for five or more minutes like that cop though. This seems like the ideal answer for dealing with violent suspects.

Yeah...…...burning down your own neighborhoods will get'r done. I say, encore! Next up, LA? Houston?, Chicago?, Detroit? Seattle? NY? POPCORN? :corn:

Reality: This was a useless and unnecessary event.....the supposed "POLICE OFFICER" in question should have never been allowed back on the force after a history of having a record of at least a dozen complaints of abuse on his record. Don't look to the federal government to lay blame.....look only as far as the local leadership of Minneapolis. Look for event after event such as this all the way through Nov. these corrupt leaders are fighting for their political lives. Dollars to a doughnut...…..the ORGANGE MAN is to blame for the failures of blue state corrupt leadership.

Who is the Mayor of Minneapolis? Yet another left wing "COMMUNITY ORGANIZER" void of any type of real world experience.....all any DEM politician looks for is ACCOLADE. Its like watching bad acting on a movie set with a 50 dollar budget....filmed entirely on a cell camera.

'

I'd bet a number of the violent ones don't even live around there. Even a dog won't eat where it shits.
