Contrary to what some seem to think, the Constitution doesn't require the House to "immediately" refer impeachment to the Senate. It is silent on the process and timing and, in fact, doesn't require the House to refer the Articles to the Senate at any particular time or even at all.

However, the Senate rules on impeachment require the Senate to begin action "immediately" after receiving notice from the House that impeachment managers have been appointed. When such notice is received from the House, the rules require the Senate to "receive" the managers to present the articles and upon presentation, the Senate must begin the trial at 1:00 pm the day after the presentation.

So, under its own rules, the Senate cannot begin its part of the impeachment process until the House notifies them that managers have been appointed - meaning that it's completely up to the House when the Senate process is triggered. Until Pelosi appoints managers and notifies the Senate thereof, there's nothing for the Senate to do.

Last night, Pelosi indicated that she may not appoint managers until the Senate provides her additional information about how they plan to proceed since she needs to have these details in order to appoint the appropriate managers.

In other words, she's saying "You can't start until I tell you to. But I'm not going to tell you to until you lay out your plan for me."

She is forcing Mitch's hand and keeping full control of the articles until he shows it - and she's doing it by using HIS rules against him.

She's obviously gamed all of this out so far ahead of everyone they never saw it coming. And no doubt, she has all of her next moves worked out and ready to go when the time comes. I can't wait to see what she has in store.

Here is the real challenge- before anyone starts to taking any Victory dances!

We have a Rogue president out to destroy our Democratic processes and institutions, Truth itself, The Media, and decency with the full support of the Republican Party!

We also have a Rogue Leader of the Senate, who instead of doing his Constitutional Duty to be an oversight and check and balance to the executive branch, now taking his orders from Donald Trump, who is clearly taking his orders from PUTIN! I mean, just last week, Donald Trump was on the phone with Putin, and he asked Putin what the US foreign policy should be with North Korea!

So Donald Trump is a dictator, placing himself above the law, not upholding his oath of office to protect our Constitution, and we have the leader of our Legislation Branch, not upholding his oath of office to follow the Constitution, while protecting this Rogue president who is corrupting all three branches of our government.

Because Donald Trump and his "Fixer" who is our Congressional Leader, has been stacking the highest courts in the land with Rogue Right-Wing political hacks who are not even lawyers who have ever even tried a case .

That is corrupting all three branches of our government with Rogue White Nationalist Right-Wing agents hell-bent to destroy our Democracy and Democratic institutions and keep a Dictator in power!

So, this is war! A War the Democrats and the people of our country did not ask for- but we must fight!

Donald Trump and his supporters are the enemies of Democracy and Free elections.

So here in this forum, we must call them out as enemies, and fight them with the facts and the truth- and our vote!

But, please realize these people are the enemy and treat them as such!

Just as the house has sole power to impeach or not, the senate has sole power to decline to try any impeachment that the house elects to vote. Being that there isnt anything in the Constitution that specifies what constitutes a trial. The senate can just simply motion to vote on the dismissal of impeachment.

I don't understand how they got "out-foxed while they didn't even see it coming". Your house clown car voted to charge Trump with some "high crimes and misdemeanors". Now it goes to the senate, where I presume the usual procedure would be for the majority to come up with the rules for the trial. Both sides have to know the rules, so as far as I know, the old bag can hold on to those things as long as she wants. But if she won't give 'em up because she doesn't like the rules, and the turtle won't change them, let's see who's gonna be squirming like toads
