A "split jury" would be called a hung jury in this case. They would be forced to deliberate for longer, in hopes of coming to an unanimous decision. Failing that, Durham could have gone for a retrial.

That is what Durham was hoping for. He could scare Sussmann with repeated trials, each one with the possibility of being found guilty.

No Durham lost completely, and Sussmann was found NOT GUILTY. Double jeopardy was attached. There is no way to ever do this trial again.
