Supreme Court slaps down Trump again on DACA

The Court did not rule on the legitimacy of DACA, It ruled on the procedure that was used to end DACA. The procedure can be be redone per the rules for ending an EO and then the outcome in the S,C. will probably be different.
 
Roberts is no hero. He voted as he had to due to Trump's justice dept. incompetency. But he gave them a blueprint for how to refile to get another decision. They do not have time to get it done this term, but if Daffy, the hater,gets a new term. He can get DACA killed. In how many ways is this group unable to do their jobs? Maybe Roberts can write it for them next time.

I don't want my SCOTUS to be heroes. They are like baseball umpires. I want them to make decisions based on the law. That happened in this case. Trump wanted an easy way out, Roberts said no. But dreamers are here illegally, so obviously if there is a decision by the Administration to deport them, it will be legal, but not ethical or popular.
 
Everyone should have a dream, but why don't immigrants fight for their countries laws to change and not come here to live off the taxpayers backs? Some have been here 30, 40 years + and have made no effort to become citizens. Obama created a nightmare for taxpayers that have to shoulder welfare, medical, everything that taxpayers can't even afford for themselves or their children. Mr. President, we're tired of being slaves, not only to the government that orders us to pay outrageous taxes every year, slaves to support people that refuse to work, not to mention thieving government workers like Obama, Hillary, Maxine Waters, etc that continue to steal from taxpayers and the justice system that let's them move among us, while they jail people that get a Jay walking ticket. Time for this to stop!
 
You guys need to read the decision more carefully.

All the Supreme Court did was throw out the way Trump was getting rid of the policy. They clearly stated he could if he did it in a procedurally correct fashion.

“We do not decide whether DACA or its rescission are sound policies,” Roberts wrote. “We address only whether the [Department of Homeland Security] complied with the procedural requirement that it provide a reasoned explanation for its action. Here the agency failed to consider the conspicuous issues of whether to retain forbearance and what if anything to do about the hardship to DACA recipients. That dual failure raises doubts about whether the agency appreciated the scope of its discretion or exercised that discretion in a reasonable manner.”

So, for all those gloating that DACA is now inviolate, you are wrong. All Trump needs to do is get better liars... err lawyers... to fill out the paperwork to kill it off correctly.

Likely, from Trump's point-of-view, this just means doing the paperwork over and still getting rid of DACA.

Yes and no. Trump will be forced to overtly act, and he didn't want to. Because removing protections for Dreamers is incredibly unpopular. But good luck!

So you're for separating children from their parents when the parents are deported for breaking the law? I wouldn't of thought...

We do this all the time when the parents are criminals and go to jail. The children are put in foster care, etc. Here, the parents are deported and their kids go with them. It's not the America's fault that the parents committed a crime and their children have never been in some foreign country or speak that language. Maybe the parents should have thought about that before they broke US law.

ROTFLFMAO!!! Dreamers are not children. They are adults. They have jobs, they go to college, they are active members of our society and have been for years.

Red herring in the form of a strawman. What does this have to do with the Trump administration making a procedural error in ending a program to shield them from deportation?
 
can somebody explain why an EO is not simply able to be overturned by the next POTUS?

There is a procedure for doing so...i's must be dotted, t's crossed.

The procedure will be correct next time and the illegal DACA will end.
