Ummm...I think they knew. However, like Confederate soldiers during the Civil War, they were fighting for their country, not just an assholish political party.

Interstate travel, and commerce is not a Constitutional right, but rather a federal law. Even there the states have some power to prevent it. The particular argument that Texas is following is that parents are not allowed to transport children out of state for illegal reasons. For instance, a father cannot transport a child out of state to steal custody from a mother. Or a mother cannot transport a child out of state to avoid a child abuse prosecution. No one can transport a child out of state to have sex with him or her. Well if life begins at conception, then Texas thinks it has a right to prevent pregnant women from transporting their fetus out of state.

There is an interesting side no. It might be illegal to put pregnant women in Texas jails and prisons. It is illegal to put people not even suspected of a crime in jail or prison, and the fetus absolutely did not commit a crime.

wrong. It's also the same precedent time line that the SCOTUS told us that it is an inherent RIGHT to contract. Federal law just regulates how it is done.

It is not illegal to imprison pregnant women. It IS illegal to jail people not suspected of a crime, however, the courts have almost always accepted the good faith argument from the government, so little if any punishment happens to the state.

No the fetus is innocent and should not be given the death sentence by its mother either.

And the fetus is not suspected of any crime... So if a fetus is a citizen, which some states argue, then it is illegal to put a fetus in jail. The only way to release the fetus from jail is to release the pregnant woman, so that seems like a loophole to get out of jail.

There are no certainties yet, but it looks like Texas' attempt to control women may backfire in this case. We will see if they are able to prevent pregnant women from leaving the state of get abortions.
