I never called Solitary a retard. I called his argument retarded. The Founders had printing presses and knew full well the power of the printed and spoken word. And the 10th amendment argument is just plain- well, retarded.

What the founding fathers had or didn't have is not as much the issue as is your argument being able to be turned on the rest of our rights.

The printing presses of the 1700s were as unlike the media today as an uzi or hand grenade is unlike the muskets our founding fathers used.

If you want to use the phrase "I don't think the Founders envisioned...", then be prepared for others to use that same phrase against other constitutionally guaranteed freedoms.

There should be no gun bans and then there would be no black market.
 
Photos were not envisioned by the founders, so should we not protect photographic images under the first amendment? The founders did not envision the computer and the interwebs where bad guys could communicate with one another in secret, so maybe we should, and in fact have, not protect computer communications.
