Courts are supposed to adjudicate active cases, and decide them within the law. Thomas is soliciting to create a case and undue the law.

Even under the most strong arguments for State Rights, the idea that a State should be able to dictate your private actions (using a condom or having anal sex, etc) in the privacy of your home and bedroom, is just absurd.

The republican's of prior generations were all for keeping the gov't out of peoples homes and not to criminalize personal choice actions between consenting adults.

Not only is it absurd, but it is clearly unconstitutional. We are guaranteed a right to privacy in our own homes. Fourth Amendment. Maybe Clarence Thomas could benefit from reading it.

This Natural law is Divinely ordained by God (the Biblical God).


So, despite what the Constitution says, America was founded on purely Christian moral precepts. From 4th July, 1776 America was implicity/tacitly - and - "for all intents and purposes" - a Christian republic.

You're correct the Declaration of Independence "was essentially a MORAL document". It is also a revolutionary document but it isn't a foundational document for a national government. That document is The Constitution.
