There has been a lot of alt right lying about what happened to Paul Pelosi, but the truth is far more boring.

Pelosi had a blood alcohol reading of 0.082%, which is just barely above 0.08%.
Had he fought the reading, there is a real chance he could have gotten it thrown out. He was not falling down drunk, he was buzzed. He should not have been driving, and he admitted that. Rather than use his wealth and contacts to get out of it, he plead guilty.

He was sentenced to 5 days in jail and 3 years probation. That is a little harsher than usual, but basically standard. For those who claimed he would use contacts to get out of charges... He is spending time in jail.
The blood was drawn over two hours after the wreck. So there is no doubt it was considerably higher at the time of the wreck. Plus hospital chemistry machines are very accurate. So if I was on a jury he wouldn't have gotten away with it. Plus time served for literally two hours at the jailhouse is pretty light. He got basically a slap on the wrist for accident that could have easily resulted in a death. Pretty much what I thought he would get.

On May 28 at or around 10:17 pm, a caller to 911 emergency services first reported the accident that took place about 5 miles from Pelosi’s sprawling vineyard estate, according to a criminal complaint, with medics and Napa deputies arriving first on the scene although the incident was handled by the California Highway Patrol.

“Records show CHP officially arrested Pelosi, the husband of House Speaker Nancy Pelosi, at 11:44 p.m., before they took the blood sample at their Napa office,” Fox News reported. “Police obtained the sample at 12:32 a.m. on May 29, 2 hours and 15 minutes after police received the 911 call. The result found his BAC to be .082%.”

According to Fox News, “Pelosi is 6 feet, 2 inches tall and weighs around 200 pounds, according to the criminal complaint. But the human body burns off alcohol at a standard rate of about .016% per hour, regardless of a person’s size, according to legal and medical experts. At the time of the crash, Pelosi’s BAC was likely higher than at the time of the test.”

“California lawyers are well aware that blood alcohol is [metabolized] at a fixed rate, so much per hour,” according to a retired attorney who spoke with Fox News Digital. “So the 0.82% of alcohol in Mr. Pelosi’s bloodstream hours after the crash can easily be converted to a substantially higher BAC at the time of the crash.”

BAC first goes up a bit, and then goes down slowly, so it could be a bit higher, or a bit lower. It would be unlikely that it would be considerably higher.

He got time served for two DAYS that he already served. Time served is the time he served before being bailed out. He was credited with two days, because he served two days.

What the better defense attorneys are pointing out is the absorption rate. That can be up to 2 hours for a single drink of alcohol. An absorption rate of 0.25 ounces of alcohol per hour would be typical.

So it is possible that he was driving around at 0.078%, and it went up to 0.084% after he was driving, and then dropped down to 0.082% when he was tested.

And remember, Paul Pelosi had the money to hire the best lawyers... There is a real problem with him doing that. He would be able to get out from under the charges, but it would have looked shady, and would have hurt his wife's political career.

In the UK, a driver can flee the scene and go home. However the police can calculate the amount of alcohol at the time of the accident and act accordingly.
 
Every time anyone drives, they could have killed another driver. The law does not punish what could have happened, but did not.
