NY Penal Code 175.10

He has an indictment and an arrest.

The crime, likely three of them, exists and will be shared when required.

If not, the case will be dismissed.

Still locked in your paradox. Which is it, dude?
No crime is listed as REQUIRED. Therefore there is no crime. Void argument fallacy.

The case will be dismissed, for there is no case.

Again with this stupidity i owned you on in the other thread.

Bragg will follow NYS law.
He isn't. He's already violated it.
Trump derps crying saying 'but i demand to know now or it does not exist' will not change that.
It is REQUIRED information on both the indictment AND on the facts and specifications.
At this stage of the proceeding Bragg is under no obligation to present that part of his case.
YES HE IS.
The Trump legal team will request a Bill of Particulars at some point when they feel that detail needs to be presented and that is when the process, as directed by a judge will require it be presented as the trial moves to the next stages.
The will be presenting this as well.
No amount of tears from you crying 'but i want to see it now' will make Bragg comply when the law does not require it.
The law DOES REQUIRE IT.

“A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.

Falsifying business records in the first degree is a class E felony.“

Lots of people who have never done criminal law maybe can’t understand what is called barebones pleading. It’s how a charging document such as an indictment is done.

The prosecutor only provides the basic minimum that is required to say the Defendant committed a stated crime. Often no facts other than dates and allegations tracking the statute said to have been violated are provided. Barr actually filed what’s called a speaking indictment which provides a little more information.

The reason prosecutor give such a barebones fact pattern is, one… to give as little information as possible until required to do so, and more importantly two… to allow for as much flexibility as possible. A bare bones indictment gives the prosecutor more wiggle room is new evidence comes to light changing how he plans to go about proving the case and making it easier to file a superseding indictment if new more serious crimes come to light while the case is pending.

Having a very vague indictment gives flexibility.

If, for example, Bragg had listed what crime Trump was trying to commit in filing the fraudulent documents, he would be limited to that crime, even if another easier to prove crime later came to light.

A vague indictment meeting the pleading requirements is good lawyering.

It's interesting how legal facts can trigger the poutraged RWers into placing their impotent groans on a post containing them. lol

I can't think of any other way to file it either.

Nope. It is completely legal for Trump to contribute any amount without limit to his own campaign. Beyond a certain amount, he can no longer use government provided campaign funds (which he didn't anyway).

Another valid point that is often overlooked by Bragg and these other twits. How the heck can a payment AFTER the election be considered a 'campaign contribution'???? Apparently that doesn't matter to Bragg or any of these other twits.

Since his company logged them, and they were paid to Cohen, I can't see how they were 'falsified'.

Oddly enough, Cohen himself was convicted of perjury and tax evasion. He lied on his personal taxes and lied about his financial information on a personal real estate transaction and loan application, and for violating campaign finance laws (by contributing too much).

Stormy Daniels has also tried this extortion before. When she tried to sue Trump as part of the extortion, she lost in the countersuit and had to pay Trump a substantial amount of money.

Bragg is exposing himself to a malicious prosecution lawsuit. Stormy is exposing herself to a perjury charge if she tries extortion again or tries to be a prosecution witness (she signed an NDA). Cohen as since completed his prison sentence and paid his $50,000 fine and now holds a grudge against Trump, blaming Trump for his own ills.

Meanwhile, it just more of "Get Trump" by hook or by crook, and more "We've Finally Got Him!" chanting. They've been doing it for EIGHT YEARS.

They are scared shitless that Trump will not only get nominated, but will win.
