You moron. People are killed every day by idiots who inadvertently run a red light or who are playing on a phone They weren't trying to harm anyone but it's still a crime.

Running a red light, or playing on the phone would be on-purpose illegal actions. It creates an initial crime that can allow the accident to be prosecuted. You are not going to get murder out of it, but you will get some crime.

Not seeing a pedestrian would not be on-purpose. If they had a crossing guard, you could get disobeying the crossing guard, but they failed to provide a crossing guard due to budget cuts.
