I'll leave assessment of its size to you.

I know of no clause in the Geneva conventions that exempts non-State actors. To the contrary, iirc President Bush invoked the "for the duration" standard when he began to pack Gitmo with cab drivers and goat herders.
The Bushies declared that prison population "the worst of the worst". And by the end of their administration they'd released more than half of them. They were so bad, they were released.

It's not a logical fallacy.
But it is a deference to authority.
He knows more about it than I do.
He knows more about it than YOU do.

I'm not sure what logic has to do with it.

I could type out the ethical / pragmatic argument; but simply don't want to waste my time.
 
what do you tell the innocent person that unwittingly got caught up in the net and was tortured? or does your government not make those mistakes?

There were no innocents that were unwittingly caught up in the net and tortured you twit. But if you find any and have a credible source to prove this is what happened, I am all eyes.
