He warned Kimmel that his lie was not "in the public interest." That's his responsibility as a FCC Commissioner.

The first amendment does not have a clause exempting Free Speech for what the current regime thinks is in the public interest.

Kimmel's show frequently has Democrat politicians but rarely has Republican politicians it is basically an in kind political contribution for Democrats.
