This is the ruling that says he can't be deported to El Salvador. Where was he deported? Do you think due process means that the executive branch can jail someone if the court says they are not guilty or can't be jailed?

So, what do you propose? Let's bring him back to the US and slap him straight into a federal prison or jail to be held without bond as a flight risk until his hearing. Additionally, since he's obviously an MS 13 member, let's slap some terrorist charges on him and try him for that too. Chances are pretty damn good he'll end up, at a minimum, in a US prison for double digits with a whopping six-figure fine to boot.

Or, maybe the US can find a third-party nation--I suggest Kazakhstan or maybe Pitcairn Island as possibilities--given a suitable compensation for their taking him and making sure he stays there.

One thing is for certain, he is returned in the next 3-ish years to the US, he's going to get thoroughly and totally fucked by the government, no judge withstanding.

He is not obviously an MS 13 member. In fact the government has not presented any actual evidence to a court of him being a member of MS-13. The only thing they have is double hearsay which is not acceptable in any court in the US. I see you are now proposing that people be jailed for crimes without a trial or an indictment. Garcia has not been charged with any crime and has not been convicted of any crimes.

Yes, he is. Several police departments say he is. Reliable informants say he is. The only counter claim to that is his own word that he isn't. His membership in MS 13 does not require him to have committed any crimes (which he has) or be convicted of the same (which he hasn't). He has been charged, simply not tried and convicted.

That is interesting since when I check the actual Tennessee law it is a class C misdemeanor to not carry a license. It has a $10 fine.
