Why did none of those assistants conduct the grand jury indictment but it was the acting US Attorney that had just been apppointed?

The problem is that experienced litigators know they can't lie to the court. That makes it hard to prosecute a case where the evidence is weak.
 
Comey is going to claim people lie to congress all the time and nothing is done to them. Well - he got that right.
Why would Comey make that argument? He can simply provide the court all of the statements by Trump and others to show vindictive prosecution.

The funniest part of this will be when the court grants Comey the right to subpoena Trump to ask him if he had any contact with the DOJ about Comey. Once Trump is under oath, he will be fair game for almost any question.

I'm pretty sure trump will never testify, even if subpeona'd. SCOTUS is pretty protective of trump.
