Yes they are because there are 22 million millionaires in the US, most of whom probably cheat on their taxes.

Many of those millionaires are not in the top 10% of earners.
A retired couple with $2 million could have a taxable income of $40,000 if they are only collecting 2% in dividends. It's called an income tax because it is on income. The cheating is done by those that can hide their income in some fashion. Either by not declaring it or taking specious write offs.
