No Walt they are free to cure the James case by refiling the James case . The Comey case is more problematic because of the statute of limitation . It may have to be appealed to the SCOTUS. The Judge that threw out the case actually inserted words into the law she used to throw out the case. The bottom line the judge says ONLY the court can now decide who can be in Halligan's position. That violates separation of Power. The decision of who fills the office that Halligan holds belongs to the Executive branch.

False. For the James case to be brought again, the Justice Dept. only needs to fix the administrative problem cited, i.e. have a Senate-approved prosecutor.

Comey's statute of limitations ended, so there is no refiling on that. The indictment lacks a specific allegation, and there is no replace that, so appeals are unlikely to flip the case...

Maybe trump can suspend laws and convict him that way.
There is a narrow path to potentially bring the Comey case and the Appeals court and maybe the SC will have to decide if they want to consider that narrow path.

If they do, the likelihood of success is tiny, according to most experts.

The path is hinged on a State law that can allow refiling of cases that were filled before a statute ran out if the case is thrown out on technical issues only. But because this error was govt incompetence and not some simple technical issue to be corrected it would be rewarding the gov't by giving them a do over for their incompetance.
 
i want both James and Comey to be revived, selfishly, as they BOTH will be dismissed again before trial, but on the more serious issues of grand jury abuse and other abuses that can get Halligan and Bondi sanctioned and potentially losing their law licenses and facing future criminal investigations that Trump will need to pardon them in advance for.

Actually the Obama appointed judge has to insert a word in the law she used to come up with her dismissal. He ruling violates the separation of powers in the constitution and should be overruled if this cases makes it into the SCOTUS.

trump is trying to do the near impossible, with the least qualified lawyers imaginable. Anything is possible, but only the alt right would hold their breath on this one.
