Fani Willis unleashes the Kraken: Trump and 18 others indicted on racketeering charge

Nothing ridiculous about the charges, but yes, other states may want to follow Georgia's lead, and start filing charges in their states. Arizona, Pennsylvania, and Michigan come to mind!

I am expecting it.

So Trump has 96 criminal charges against him, I expect it to reach at least 150.
 
What we need to consider is there is a about a 50/50 chance Trump will win on a motion to remove this Federal Court.

Fani and her team would be well aware that could be the case.

Trump failed in the NYS case (Alvin Bragg) as his actions with Stormy took place prior to him being POTUS outside the one payment he made while POTUS. Also he was trying to delay payments to when he was POTUS so he could then reneg and not pay her proving even more that he did not care if people knew once he was in Office. This was all about protecting his campaign.

In this case the compelling point Trump has is he did all of this while POTUS, and in belief it was his job to do so as POTUS.

On the other side 'a foundation of lies are not a reason to remove a case from State to Federal court'


So the State APpeals Court may rule either way here.


What that DOES NOT mean, is that Fani and her team will not still be the prosecutors. THEY WILL. And the Georgia State laws will still apply. I just means a Federal Judge and a wider jury pool.

It would however open it up to pardon power. Trump would certainly test it, if POTUS by the time this case was scheduled because unlike other Federal cases his DoJ would have no power to intervene or stop it. Pardon would be his only path. And his self pardon would fail at the SC, IMO. No SC would or should allow a POTUS to self pardon as it means they could actively just blatantly commit any Federal crimes in real time and just keep pardoning themselves as they go. The SC would almost certainly on the side of the law that says 'No man can be judge and jury in his own trial', and limit the pardon power thusly.

But Trump would be able to pardon any and all other accused in that trial. His power would be absolute there. Not sure it would help him though, as Fani would then just call them all as witness and they would have no 5th amendment right to not testify. And unburdened by the pardon from any jail risk, would any of them want to lie for Trump and thus risk going to jail again, having just escaped it. That is why Trump refused to deliver pardons to all of them after Jan6th, when he could have. His lawyers reportedly told him they would all then become witnesses with no 5th protections. Better to keep them all in the same boat as defendants.


My betting money is on Trump getting it removed to Federal court.

In a 98-page document naming 19 different defendants (as well as roughly 30 unindicted co-conspirators, along with "others not named"), Fulton County District Attorney Fani Willis outlined a large-scale alleged conspiracy to keep Trump in power through corrupt tactics following the 2020 presidential election. In addition to Trump, the indictment names well-known Trump confidants and advisers — including Rudy Giuliani, John Eastman, Mark Meadows, Jeffrey Clark, Kenneth Chesebro, Jenna Ellis and Sidney Powell — as well as several Georgia Republican officials allegedly involved in either the "fake elector" scheme or in breaching the voting systems in rural Coffee County.
