For the exact same reason someone can be found guilty of murder if you don't know the exact day it happened.

Trump had lawyers to defend him. They surely would have made that argument to the jury. The jury found it to be not convincing.
Trump refused to get on the stand and testify. If Trump was so innocent why wouldn't he testify?
The problem is that Trump has lied repeatedly and would have been shown to have lied repeatedly making they jury even more likely to think he committed the assault. Trump was asked to provide DNA to compare to what was on the dress she wore. He refused to do that. If he was so innocent, why didn't he provide DNA right away to make this all go away?
Then he would only have 9 fingers.

LOL. I show you the jury questionnaire form that they returned showing they found that the preponderance of evidence showed that Trump sexually assaulted E Jean Carrol and you respond like a 3 year old with, "Did not."
Would you like to know how much of the monetary award was for the sexual assault? If I tell you, will you simply close your eyes and chant, "nah, nah, nah, nah" so you don't have to accept reality?

There is a difference between my legal opinion and what the Federal Law says, in fact there are big differences between the State laws and the Federal Laws.
I defended a guy once who kissed a woman but it turned out to be against her will. The State charged him with Battery, not sexual assault, because the prosecutor did not think it was sexual assault.
That being said, my opinion and the law are two different things, if you had asked me about the law, I would have had to look New York law and tell you how it is defined.
I understand from media reports, the civil law definition of rape is different than the criminal law definition in New York. Apparently in New York, what TACO did would be rape under the Criminal Law, but is Sexual Assault under the Civil Law.
