The Justice Department filed a lawsuit today against Space Exploration Technologies Corporation (SpaceX) for discriminating against asylees and refugees in hiring. The lawsuit alleges that, from at least September 2018 to May 2022, SpaceX routinely discouraged asylees and refugees from applying and refused to hire or consider them, because of their citizenship status, in violation of the Immigration and Nationality Act (INA).

In job postings and public statements over several years, SpaceX wrongly claimed that under federal regulations known as “export control laws,” SpaceX could hire only U.S. citizens and lawful permanent residents, sometimes referred to as “green card holders.” Export control laws impose no such hiring restrictions. Moreover, asylees’ and refugees’ permission to live and work in the United States does not expire, and they stand on equal footing with U.S. citizens and lawful permanent residents under export control laws. Under these laws, companies like SpaceX can hire asylees and refugees for the same positions they would hire U.S. citizens and lawful permanent residents. And once hired, asylees and refugees can access export-controlled information and materials without additional government approval, just like U.S. citizens and lawful permanent residents.

That's the DOJ's version. Musk's version is they couldn't hire foreign nationals due to the ITAR laws in place:

Recently, the State Department and DOJ changed some of these rules so refugees and asylum seekers might hold jobs in companies that fall under the ITAR regulations. I won't get into how stupid that is, but they did it.
The DOJ then started hammering Space X in particular about not hiring such persons, as if they would suddenly start hiring lots of them just because of their status.

This lawsuit is about political correctness coming from the radical Left (eg., Bribem's Stalinist DOJ) rather than reasonable law and a reasonable position. The ITAR previously excluded foreign permanent residents in the US because they were still foreign nationals. Now the DOJ seems to be saying It's okay to hire foreign nationals so long as they they're living in the US.

The DOJ needs a history lesson: Qian Xuesen, you never heard of him. Brilliant Chinese national who was a US permanent resident back in the 30's and 40's. Helped the US in a big way get ICBM's going. Went back to China and worked for the communists there. Is known in China as "The Father of Rocketry" there. He single handedly put China on the road to developing their own ICBM's.

But I guess history can't repeat itself... The DOJ is doing what they're doing for political rather than sound legal reasons.

Who actually is demented? You obviously are writing the above. Bribem can't even make complete sentences half the time. He clearly doesn't know where he is much of the time either. He shuffles more than he walks.

On top of that, Joke has always been a dullard and dimwit. He regularly says stupid stuff, incredibly stupid stuff. He knows little or nothing on any particular subject, and demonstrates it regularly.

The thread title is a lie.

DOJ is going after Musk by eliminating candidates based on citizenship status, which is illegal. They were denied employment, period. Not just ‘Americans first’ and then the rest.
