Yep, the broke dick Bribem administration DOJ (Department of Jokes at this point) is suing Elon Musk, and Space X, for hiring Americans in preference to refugees and "asylum seekers" (aka illegals with a court date).

So much for illegals and such "Taking jobs Americans don't want to do." Now, the Bribem administration is taking American jobs and giving them to foreigners...

That wasn't what Space X was doing. They weren't taking foreign nationals here on a green card that could legally work in the US. Their justification for that was that much of what they did fell under laws that prohibit foreigners from working in particular areas of technology and research under export control laws. It is akin to requiring someone to have a security clearance to have a particular job.

Space X cited this repeatedly saying the same DOJ and other government agencies told them they couldn't use foreign nationals on a green card as employees. Seems the DOJ is just making shit up as they go these days...

This just keeps getting stupider by the minute. In the DOJ's suit, they want as a remedy for this supposed not hiring practice, that Space X will have to pay the full wages with interest, and a penalty for each person since 2008 that Space X turned away because they were a foreign national for the full period from when they applied to work there. This lunacy assumes anyone in that category would have been hired, would have stayed the entire time, at Space X for employment. Talk about a windfall for the recipients!

What's even more hilarious is that the DOJ changed their position on hiring of foreign nationals for positions at companies doing advanced technology that could go into weapons just a couple of months before filing this lawsuit. You have to wonder if the DOJ wasn't just targeting Space X because the Bribem administration doesn't like Musk for what he did to Twitter or something...

That was 2016. The DOJ changed the rules in 2023 shortly before they went after Musk for not following the new rules and made the rule ex post facto (eg., illegal) as well.

The lawsuit also cites public comments made by Musk and another SpaceX executive, such as a 2020 tweet by Musk that "U.S. law requires at least a green card to be hired at SpaceX, as rockets are advanced weapons technology."

Musk on Thursday described the lawsuit as "weaponization of the DOJ for political purposes." He said SpaceX had been told repeatedly that hiring non-citizens could be a criminal offense.

But in the April guidance, the Justice Department said the opposite - that export control laws do not implicate hiring or bar the employment of any "U.S. persons," which the agency defined to include asylees and refugees because they are permitted to live and work in the United States.

Companies may need special permission from federal agencies to share export-controlled information with workers who are not U.S. persons, according to the guidance.

The DOJ did not directly cite its guidance in the SpaceX lawsuit, but used nearly identical language to describe the company's alleged violations.

"Export control laws and regulations do not prohibit or restrict employers from hiring asylees and refugees; those laws treat asylees and refugees just like U.S. citizens," the department said.
