Does trump have a viable defense?

How were the documents hidden when the FBI had visited the residence and made additional request for locks?

The DOJ was in conversations with Trumps attorneys who never resisted any DOJ requests? So why a massive raid on the residence?

If you bothered to read the indictment the answers would be obvious as to how the documents were hidden.

On May 22nd, Trump was told by his lawyers that they would have to search all the boxes he brought from the White House to comply with the subpoena.
Between May 22 and May 30, Trump had 64 boxes moved out of the storage closet to his residence.
Only 30 boxes were returned before the search on June 2.
Trump never told his lawyers he had moved the boxes or that some the boxes weren't in the storage room.

When the FBI later did their own search, they found 102 documents that should have been found by the lawyers if the documents had not been hidden from them.
 
Trump correctly believed that under the PRA, he had right to keep the documents and determine what would go to the NA. There is no "willful" intent when there is no crime.

Why didn't the Feds immediately enforce the law and take them from Trump. Instead, the Justice Dept seems to have employed a policy of prolonged patience and an acceptance of negotiations, discussions and requests. Then suddenly there is a raid and now criminal charges. The Justice Dept could be accused of entrapment. They plotted to have no immediate enforcement of the law, they plotted to employ a perceived acceptance of negotiations, and they plotted not to issue a written warning about a specific end date for all negotiations. Therefore, they plotted to entrap Trump. The Trump lawyers could say it was a setup/entrapment by a corrupt Justice Dept and corrupt FBI once again interfering in a Trump presidential election and once again guilty of selective treatment and enforcement. Enforcement and treatment not given to their political friends - and there seems to be ample evidence of that behavior.



They did "keep" the documents in unsecure location. They were not authorized to ever take the documents which is a violation of Federal laws. It doesn't matter that they gave them back, it was ILLEGAL for them to have them in the first place.

First you whine that they didn't have to send the FBI to do a raid but instead should have negotiated. Now you whine that they shouldn't have negotiated but should have sent the FBI earlier to just take them. Trump's decision to not turn over documents is not entrapment since he could have simply complied and avoided any criminal charges.

Equal protection under the law was once viewed as sacrosanct in America. I realize that we have a Reich now and the democrats are not subject to any laws - still the most viable defense for Trump is simply that he be held to the same standard of law that Joe Biden and Hillary Clinton are held to.

Comey set precedence when he excused Hillary for her handling of classified documents. The open coverup of Biden's theft and mishandling of documents is an affirmative defense by Trump showing that this is a political witch hunt.
 
Agree. The charges seem air tight. Trump had no right to possess those documents and refused explicit requests to return them.

His defense is the same one used very unsuccessfully in the black community - "I am being unfairly targeted". "They hate me and are out to get me"

I guess it's a viable defense if you completely ignore the crimes Trump is charged with. The problem is that it won't work to defend against the crimes Trump is actually charged with.
 
The day Trump left the White House was the day he stopped being Commander in Chief. He had no right to possess those documents.

Trump had no right to possess top secret documents after he left the office of President.
