Does trump have a viable defense?

Trump is goin' down.

It's the best thing that could happen to America, for those who have been conned by him to see what a crook he is. Worst since tricky Dick.
 
This is a case where Trumps only real defense is to take the stand and make the case and appeal to the jury himself, that he really acted in good faith and DID believe he had the right to do what he did.

Just as in the E Jean Carroll case his best possible defense would have been for him to take the stand and testify to the jury, that it was consensual, and she made the moves that initiated the contact, true or not.


The problem is those are the two best defenses for normal people. Trump is a moron, truly, whose own lawyers simply know they cannot get him anywhere near the stand, and sworn in as he will always make things worse for himself while also perjuring himself many times over leading to new charges.

Trump ("that is Marla, my ex wife") is so dumb, he cannot do what many semi competent criminals can do and that is lie effectively to save his life. He is incapable of being strategic or effective because he is dumb. He cannot foresee how bad things sound or how obvious and blatant a lie is, and that a jury would see, before saying it.
 
I read the indictment. It lays out evidence of the crimes.

Obstruction is not complying with a subpoena and hiding the documents that were subpoenaed. The evidence is laid out with the indictment documents.

How were the documents hidden when the FBI had visited the residence and made additional request for locks?

The DOJ was in conversations with Trumps attorneys who never resisted any DOJ requests? So why a massive raid on the residence?

Biden was never subpoenaed and never hid documents that were required to be turned over under a subpoena.

Biden's control of the documents were ILLEGAL. His cooperation is IRRELEVANT. He had them since he was a Senator and then as VP. They had to go back to several locations to find the documents even after being told that was all of them.
 
It matters very much what Trump says since he is the one that has been indicted on a crime that requires willful intent. If Trump says he intended to keep documents he knows are classified and they were not declassified after he left office then it shows that he knew he had classified documents in his possession and his statements can be used to show he willfully committed the crime as required to make it a crime.

Trump correctly believed that under the PRA, he had right to keep the documents and determine what would go to the NA. There is no "willful" intent when there is no crime.

Why didn't the Feds immediately enforce the law and take them from Trump. Instead, the Justice Dept seems to have employed a policy of prolonged patience and an acceptance of negotiations, discussions and requests. Then suddenly there is a raid and now criminal charges. The Justice Dept could be accused of entrapment. They plotted to have no immediate enforcement of the law, they plotted to employ a perceived acceptance of negotiations, and they plotted not to issue a written warning about a specific end date for all negotiations. Therefore, they plotted to entrap Trump. The Trump lawyers could say it was a setup/entrapment by a corrupt Justice Dept and corrupt FBI once again interfering in a Trump presidential election and once again guilty of selective treatment and enforcement. Enforcement and treatment not given to their political friends - and there seems to be ample evidence of that behavior.

Biden and Pence didn't keep hide or keep documents that were subpoenaed. How hard is that to understand?

They did "keep" the documents in unsecure location. They were not authorized to ever take the documents which is a violation of Federal laws. It doesn't matter that they gave them back, it was ILLEGAL for them to have them in the first place.

It doesn't matter what one has to say. It is not against the law to be bombastic. It is not illegal for a President to declassify documents. It is not illegal for a President to control documents from his presidency.

The question of whether any of the documents are still classified or not...is not the issue at hand. The subpoena to return certain documents did NOT ask for Trump to return "classified documents", but rather to return documents MARKED CLASSIFIED.

If they were MARKED CLASSIFIED, whether they still were classified or not...Trump was ordered to return them.

He refused to do so.

Might be a good idea to buy stock in Orville Redenbacher's company. Gonna be a lot of popcorn sold this year and next.

Why didn't the ORDER all previous Presidents to return ALL documents marked "classified?"

For a third of the country, he doesn’t need a defense, he is above the law, and the only remaining jury is a percentage of the rest he and his surrogates can convince that it is all just a political conspiracy against Trump and not anything involving jurisprudence

"As a retired brigadier general who worked with classified materials my entire career, I am shocked at the alleged callousness of how these documents were handled," Bacon said in a statement. "They should not have been stored at his home and should have been completely handed over when the government requested."
