Okay so, what about the movie theatre case from this week. You get into an argument with someone because they are texting, words are exchanged, the guy is younger and stronger than you, he seems angry, then throws his popcorn in your face in a threatening way. You believe his next move is going to be to jump you.

Can you shoot?

I don't recall that going the way you have said it has, however, if it were myself in the position of the old man, I would have alerted the management first. throwing popcorn in my face might prompt me to draw, but I would wait until he made further aggressive moves before shooting.

But what if he is simply retaining the gun to defend himself in case you are going to cause him harm. Say he really needed the help, but because he does not know you wanted the gun in case you turned out to be a bad guy?

Reasonable people....not you, that is.....reasonably conclude that a person at your door at 3am with a gun that he refused to drop is not there
to defend HIMSELF....he presents a clear and present danger to you and your familty....you're not expected to know is background or reason for confronting you....
his gun is a lethal weapon and you're a target....any wrong move and your well within you rights to DEFEND YOURSELF....
REASONABLE people would agree barring any other circumstances......

Now...what about your crack about the NRA ?

yes, explain to us why you think it's unreasonable to draw a weapon after an angry and agitated individual throws something at you and acts like he is going to continue the assault

You have the circumstances, you threw popcorn, the guy has his gun drawn on you, what would you do?

Put yourself in the other guys shoes, you said that if you had popcorn thrown at you, you would draw your gun and wait for further action on the other guys part, but now put yourself in the shoes of a guy throwing popcorn having a gun drawn on you.

if I had a death wish I'd happily go after the guy and make him shoot. if I had any sense, with a gun already drawn, i'd get the hell away.

That happened to me a few winters ago. My wife, son and I were fast asleep, of course, and there was a knocking at my front door. I dressed fully and answered the door, gun in hand. "Who is it?" He responded. It was a deputy sheriff on a manhunt. Easy enough to handle in most cases unless the knocker is deranged in some way.

That's interesting my first thought when reading this is if someone knocks on my door at 3am I bet it would be a cop (with my thought being they'd have some bad news about a family member or something).

And that is exactly what I figured. I have a two brothers who work nights and are on the road constantly. But as it turns out there was a neighborhood manhunt going on and he wanted to make me aware of it. Oh, and what did he think about me answering my door, gun in hand. When he identified himself and I opened the door, I put the gun in my waistband while we continued the conversation. As he was leaving he commented to his cohort, "That's the way you answer the door at 2 in the morning." They caught the assailant the next morning at 11 in some outdoor toilets located at the cemetary, about a mile from my house.

irrelevant, dude. would you excuse a cop for drawing his gun if someone threw popcorn at him?

It was an ex-cop and still no excuse!
