Yes, I believe an employer should, for most things, be free to make business decisions. A very scientific argument can be made to show that smokers (a choice) are less productive and cause an unhealthy environment.

In 1905, the Supreme Court ruled that a state can mandate vaccines, and accompany those vaccine mandates with a criminal fine for those not in compliance.
