Often times information is marked as classified even though it has become public knowledge and was just never declassified.

She stated unequivocally that any time highly sensitive, top secret information was transmitted, she used a special, highly secure facility that is set up specifically for that kind of use.

The entire email "scandal" was just the usual right-wing smear tactics they've always used to distract the public from their own misdeeds.

The fact remains that you and I would be in severe trouble if we released Confidential information (lowest classification level) much less Top Secret (normally the highest classification level). Hillary did it with arrogance and intent. She should have been as heavily censured for her actions. President Clinton was remiss in not demanding his SoS adhere to standard protocol and laws before she left in 2013. Then CIA Director David Petraeus was asked to resign when it was revealed he had leaked classified information. Hillary should have been held to the same standard.

That's not correct. It's like saying "OJ had no intent to kill Nicole." What Comey said was there was no evidence of intent, specifically enough evidence to win a prosecution in court.

Powell says he used a private phone line to keep his communications out of the State Department servers.

“What I did do was have a personal computer that was hooked up to a private phone line (sounds ancient.),” Powell wrote. “So I could communicate with a wide range of friends directly without it going through the State Department servers."

"I even used it to do business with some foreign leaders and some of the senior folks in the Department on their personal email accounts. I did the same thing on the road in hotels," he said.

Powell was responding to a question from Clinton, now the Democratic nominee for president, about the restrictions on using a BlackBerry while in office.

Cummings said the exchange proved that Clinton’s private email server was not far out of the norm for a secretary of State.

“This email exchange shows that Secretary Powell advised Secretary Clinton with a detailed blueprint on how to skirt security rules and bypass requirements to preserve federal records, although Secretary Clinton has made clear that she did not rely on this advice,” Cummings said in a statement.

“This email exchange also illustrates the longstanding problem that no Secretary of State ever used an official unclassified email account until the current Secretary of State.”

Cummings added that Republicans’ pursuit of Clinton over her server was politically motivated; otherwise, they “would be attempting to recover Secretary Powell’s emails from AOL.”

Powell also told Clinton that he would frequently take his cellphone into Sensitive Compartmented Information Facilities (SCIF) — secure rooms where classified information was processed and mobile devices were prohibited. Powell said that he was not satisfied with the rationale for prohibiting such devices.

“When I asked why not they gave me all kinds of nonsense about how they gave out signals and could be read by spies, etc.,” he said. “Same reason they tried to keep mobile phones out of the suite. I had numerous meetings with them. We even opened one up for them to try to explain to me why it was more dangerous than say, a remote control for one of the many tvs in the suite. Or something embedded in my shoe heel.”

“So, we just went about our business and stopped asking,” he wrote. “I had an ancient version of a PDA and used it. In general, the suite was so sealed that it is hard to get signals in or out wirelessly.”

I'll give you the condensed version which deals with the point in question since attempting to read the entire thing obviously requires too much effort on your part.

In other words, even if Russian, Chinese, Iranian, or Syrian spies had hacked into Clinton’s email servers, and if they’d pored through 60,000 emails and come across these eight chains that held top secret material, they would not have learned anything the slightest bit new or worthy of their efforts. The FBI’s discoveries should be viewed in that context.

Did she commit a crime? Would anyone else—a lower-ranking official, someone who’s not a presidential candidate, someone who’s not named Clinton—have been charged with a crime? Absolutely not. And Comey said as much. “Our judgment,” he said, “is that no reasonable prosecutor would bring such a case.” In the annals of the Justice Department’s history, he went on, “we cannot find a case that would support bringing criminal charges on these facts.”

There are a few federal statutes dealing with the mishandling of classified information. Some are defined as misdemeanors, some as felonies. But all of them require the finding of an “intent” to mishandle information—and most of them involve an intent to share the information with people (usually, but not always, foreign agents) who are not cleared to see it. As Comey said of the Clinton case, “We do not see these things here.”

WHY INTENT, NOT GROSS NEGLIGENCE, IS THE STANDARD IN CLINTON CASE

In Gorin v. United States (1941), the Supreme Court heard a challenge to a conviction of a Navy intelligence official who sold classified material to the Soviet Union on Japanese intelligence operations in the United States. In that case, the defendant was charged with selling information “relating to the national defense” to a foreign power. The defendant argued on appeal that the phrase “relating to the national defense” was unconstitutionally vague, so much so that the defendant was deprived of the ability to predetermine whether his actions were a crime.

Justice Stanley Reed wrote the majority opinion and disagreed that the law was unconstitutionally vague, but only on the very narrow grounds that the law required “intent or reason to believe that the information to be obtained is to be used to the injury of the United States.” Only because the court read the law to require scienter, or bad faith, before a conviction could be sustained was the law constitutional. Otherwise, it would be too difficult for a defendant to know when exactly material related to the national defense. The court made clear that if the law criminalized the simple mishandling of classified information, it would not survive constitutional scrutiny, writing:

The sections are not simple prohibitions against obtaining or delivering to foreign powers information… relating to national defense. If this were the language, it would need to be tested by the inquiry as to whether it had double meaning or forced anyone, at his peril, to speculate as to whether certain actions violated the statute.

In other words, the defendant had to intend for his conduct to benefit a foreign power for his actions to violate 793(f).


Without the requirement of intent, the phrase “relating to the national defense” would be unconstitutionally vague. This reading of the statute has guided federal prosecutors ever since, which is why Comey based his decision not to file charges on Clinton’s lack of intent. This is also why no one has ever been convicted of violating 793(f) on a gross negligence theory.

Only one person has even been charged under a gross negligence theory: FBI Agent James Smith. Smith carried on a 20-year affair with a Chinese national who was suspected of spying for Beijing, and Smith would bring classified material to their trysts, behavior far more reckless than anything Clinton is accused of. But Smith was not convicted of violating 793(f). He struck a plea agreement that resulted in a conviction to the lesser charge of lying to federal agents. Smith was sentenced to three months of home confinement and served no jail time.

Despite what may appear to be the plain meaning of 793(f), the negligent mishandling of classified material is not a civilian criminal offense. A civilian can face many consequences for negligently mishandling classified material, including the loss of their clearance and probably with it their employment, but they would not face criminal charges. For anyone who thinks negligence should be a crime their argument is not with Director Comey but with Justice Reed, the author of the Gorin opinion. Because of that decision, the correct standard is intent, not gross negligence, and the director was right not to recommend a criminal case.

Disagreed on your skewed POV. The links didn't prove what you claimed as previously stated. Like OJ, just because there wasn't enough evidence to convict doesn't mean Hillary was "absolutely, 100 percent not guilty". The evidence does prove she used her unsecure private server to illegally pass classified information.
