Have you noticed how since the Supreme Court smacked down district courts making nationwide injunctions at the drop of a hat that these rulings have largely disappeared from the news? That sure took the wind out of the Left's sails.
Yeah there are some pretty strict rules for nationwide class action suits. It will be interesting to see if the left met all of the standards.

To get a class action, nationwide, lawsuit going takes anywhere from months to years. You have to have numerous plaintiffs, often with separate cases in different districts, with highly similar cases to bring one. This is difficult and costly to do compared to simply having one plaintiff before one judge who then rules nationwide. That's pretty quick and simple to do. It also allows judge shopping to occur as the plaintiff can usually file in a district court of their choice.
 


I saw that site, it is wrong. Canada does not have birthright citizenship for the same reason many other countries do not.

The 14th amendment is in the Constitution. The courts decide the meaning of the law and the Constitution when there are questions as to that meaning.

Well a district Federal Judge has already given them an injunction based on a class action suit filed in his court. What remains now to see is if he followed the rules or not.

Courts may interpret the Constitution, but they are not the ultimate deciders.

Most of Europe is something like that. In Switzerland, your neighbors have to vouch for you that you are sufficiently "Swiss" in how you act and whatnot for example.

I know a Federal Judge for the Northern District of Texas very well and he said he has never issued a national injunction and would never do so.

Gay marriage is a great example of that. It was made the law of the land by judicial fiat. Back when it was being debated, it ended up on 35 state's ballots in one form or another put there by the Left. The Left said, "We'll let the people decide and we're good with the outcome." In all 35 cases, including in California of all places, it was shot down often overwhelmingly.

The Left then said, "The people are idiots! They don't know what's good for them!" They went to court and got every one of those ballot initiatives overturned by activist judges--In California a gay judge who actively supported gay marriage overturned it--and it somehow became the law of the land.

That sort of thing shouldn't happen in a 'democracy.'
 
And why was the Dawes act even needed. You sure are dumb. If the 14th applied to Native Americans there would be no need for the Dawes Act or the Snyder Act.
Which side of the issue are you arguing? The 14th applied to Native Americans not associated with a tribe in 1870. Tribes were wards of the US government. They received government assistance. They had treaties. Tribes were responsible for policing criminal acts committed on a tribal member by another tribal member. Tribes were not subject to the jurisdiction of the US or the states where they were located.
And paying taxes would have ZERO affect on whether or not a person was a citizen or not.
Did you bother to read the Dawes Act? Apparently not.
The Dawes Act granted land to Native Americans. Upon accepting the land, they became taxed. Since they were not citizens at that time, accepting the land made them naturalized citizens of the state and of the US. None of those that accepted land or their descendants needed the Snyder act to become citizens.

I am curious as to how many adult native Americans you think there were in 1877 that were born after the 14th amendment was ratified in 1868.

The 14th amendment allowed some Native Americans to be citizens at birth.
The Dawes Act allowed more Native Americans to be citizens at birth.
The Snyder Act allowed ALL Native Americans to be citizens at birth.

I was born in Germany. My mom was German but became a US citizen prior to my birth and my dad was US military. I was born an American citizen, and not automatically a German citizen.

Because of my mom's German background and my being born in Germany, I could get a German citizenship and passport. But there is still a process for that.
