In order to break the law 18 793e, Biden would have had to know he had the documents, willfully retained them and not returned them to the US officer that requests them.
That is the same standard used to charge Trump. Prosecutors have to prove beyond a reasonable doubt that Trump knew he had the documents, that he was aware they should be returned but he still didn't return them.

What evidence do you have the Biden knew he had the documents. Until you can provide evidence of that beyond a reasonable doubt there is no jury in the US that would convict him and no court that would likely even let it get to a jury because of the lack of evidence.

The funny thing is almost all of the emails were classified months after she no longer had the server. Does that mean Biden can simply classify all the documents Trump has and that makes it a crime that he has them?

In a classified document, the document itself has a header that says it is classified and then paragraphs are marked where the classified information is located.

Biden's has his own Special Prosecutor who is a republican picked by Trump as DA so how about we wait and see if he comes to a finding 'Biden did nothing illegal', just as they found with Pence, or if he finds crimes biden committed similar to wha they found with Trump.

Lets hope he does not take 4+ years ala Durham's to get to his nothing burger.

If/when he clears Biden, will you accept it?

Trumpers should realize Trump is not being charged for the documents he returned, 197 of them, he’s being charged for the ones he retained and tried to hide.
