A hard-core group of liberal House Democrats is questioning the constitutionality of U.S. missile strikes against Libya, with one lawmaker raising the prospect of impeachment during a Democratic Caucus conference call on Saturday.

Reps. Jerrold Nadler (N.Y.), Donna Edwards (Md.), Mike Capuano (Mass.), Dennis Kucinich (Ohio), Maxine Waters (Calif.), Rob Andrews (N.J.), Sheila Jackson Lee (Texas), Barbara Lee (Calif.) and Del. Eleanor Holmes Norton (D.C.) “all strongly raised objections to the constitutionality of the president’s actions” during that call, said two Democratic lawmakers who took part.


Never in my wildest imagination did I ever think I would be agreeing with the likes of Nadler, Kucinich, Waters and Lee.....
I actually ashamed to tell people .....
I only hope my fellow Conservatives don't hold it against me...

Article I, Section 8: ‘‘The Congress shall have Power To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water.”
 
I would have thought it was obvious.

Obama has exceeded his authority by his order for US forces to attack Libya.

iirc....the president's war powers, in that, he can conduct military action without approval from congress. i believe the time is 90 days...but we all know that isn't accurate, but i believe the case that established the president's power to engage our military without prior approval from congress was something like that...the act has essentially allowed the president virtually unlimited war powers...see iraq and afghanistan...i don't believe congress ever officially declared war for either of those military actions....

i'm not sure where i stand on the issue because i agree the president should have broad war powers to PROTECT this country from harm. that said, it is debatable that iraq or libya posed an imminent threat to our safety. libya being less of a threat than iraq. i don't understand how liberals can support our air invasion of libya, but be against the boots on the ground invasion of iraq.

The Constitution vests in Congress the power to declare war; it does not state that the President cannot exercise his role as Commander in Chief without the explicit approval of Congress. Article II, Section II of the Constitution:

"The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any subject relating to the Duties of their respective Offices, and he shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment."

This isn't the first undeclared war against Libya, I might add. The First Barbary War, in which one of the enemies was Libya (Tripoli), was waged by Thomas Jefferson. Did Thomas Jefferson violate the Constitution?

I understand what you're getting at, but I don't believe the history backs it up. And yes, I am conservative fiscally speaking. On social issues I generally don't give a damn, so long as the behavior does not infringe upon my rights.

"The President in every possible instance shall consult with Congress before introducing United States Armed Forces into hostilities or into situations where imminent involvement in hostilities is clearly indicated by the circumstances, and after every such introduction shall consult regularly with the Congress until United States Armed Forces are no longer engaged in hostilities or have been removed from such situations."

What about James Madison, father of the Constitution, when he fought the Second Barbary War? This was also an undeclared war.

My point is that it is difficult to argue that Obama's actions are unconstitutional when James Madison and Thomas Jefferson, fierce defenders of the Constitution, took precisely the same course of action, even against the same country.

We are not living in those times, and The War Powers Act was not law then either.

Since Iraq & Libya are identical situations, aren't you equally curious as to why bravo supported Iraq, but is on the side of impeachment w/ Libya?
 
Title 50 of the US Code is pretty damn clear unless you're trying to spin its meaning and intent for some personal/political reason....

We were not in imminent danger from being attacked by Libya ....
Personally, I believe Obama should have consulted with Congress and gotten some kind of approval for committing our troops to warfare with another sovereign nation.....
We don't take orders from the UN....

Who do you imagine gave him this advice?

"Why don't you organize a group of respected Americans and ask for a meeting with Qaddafi, you can't order him to step down and get out, who the hell do you think you are?"

Its obvious (to non-pinheads) that Iraq and Libya are not identical situations...nevertheless, The Iraq WAR RESOLUTION was voted on and passed by both houses of Congress...the same procedure should have been followed in this case...and in ALL CASES that ask troops to kill in the name of the United States.

I am not aware if there was a congressional vote on Iraq's 1993 NFZ? I believe I recall one for Bosnia? Do you know?
