That was an appeal for Commerce ..wasnt it? I believe Personal Use would fall under Civil Liberties.

Raich cites wickard and others expressly detailing that congress can regulate any good that has interstate or intrastate commerce attached to it. Scalia (originalist my ass) submitted a concurring opinion citing the 'necessary and proper' clause maintaining that congress had the power and duty to prohibit items dangerous to the public.

Interesting, he could be coming at it from a fear position, or a father's position. I have not heard him talk on this issue, I'll have to go and find out why he doesn't like the substance. He smokes and it is not as bad as tobacco for your body.
