When a judge makes a ruling from the bench that doesn't follow law, bends it into a pretzel, takes the ruling far beyond the scope of their authority, or simply makes up new law out of thin air, it's a problem. This isn't something new. The only difference is that with Trump it's happening far, far, more often.

Trivial objections fallacy. I listed the Warren court's decision on legalizing abortion as a "Right." That was made up out of whole cloth as there is nothing in the Constitution or federal law that makes abortion at the time of that decision, or even since, a Right.

Clearly the Supreme Court made their ruling in Roe v. Wade out of thin air. Another is gay marriage. 35 states put it on the ballot and 35 times it was shot down by majority vote. In California it was an amendment to the state constitution. A single judge, who was gay and supported gay marriage btw, overturned that vote of the people claiming the amendment was unconstitutional based on essentially his opinion and little more.

I guess you missed the part where the USSC upheld that opinion that said that gay marriage was legal and denying it violated the US Constitution. When one judge is overturned on appeal it is possible to say they were wrong. When their ruling is upheld it is delusional to claim their ruling didn't follow the law or went beyond the scope of their authority. Every judge's ruling can be appealed.

No, the judge isn't. Trump as Commander in Chief can call up the National Guard and federalize them. He has the authority to use the Guard to assist in putting down riots, revolts, and the like. It isn't as if this is something new or unique to Trump. You and this judge are ignoring all the precedents and history where this was done.

Hundreds of protesters marched to the Portland Immigration and Customs Enforcement Detention Facility on Saturday afternoon.

It is the latest demonstration since President Donald Trump announced last week he would deploy up to 200 members of the Oregon National Guard to Portland. Late Saturday afternoon, a federal judge temporarily blocked the deployment.

Before the temporary restraining order was known publicly, protesters gathered Saturday morning at nearby Elizabeth Caruthers Park in the South Waterfront neighborhood.

They later marched a few blocks toward the detention facility at around 1 p.m. and blocked the road in front of the building. Crowds gathered peacefully and mostly stayed concentrated in front of the facility. Soon after, federal law enforcement marched out of the center and fired tear gas and smoke canisters to disperse the crowd. They also fired pepper balls at people.

It’s unclear how many were fired, but protesters near the front of the crowd said federal officers fired several canisters.

Thanks for that thoughtful and polite exposition. Roe was based on the Constitutional right of privacy. The thin air is the nonsense that we should be tied to late 18th Century ways of seeing things in making 20th and 21st Century American law. No prior Supreme Court ever entertained that strange idea.
