Many pundits were saying that was strange as it is normal to ask and get some limited version of a gag order.

And it does not matter if they are classified or not and in fact Jack filed his case under a statute that does not recognize classified or not. it just recognizes 'government documents' and the law requires them be given to the Archives when a POTUS leaves office.

This has been explained to you at least a dozen times but once again...
- The issue is not whether they are classified or not. It is that they are government doc's. Declassified doc's are still government doc's and MUST be returned. So if a former official finds they have them, they must return them. That KNOWLEDGE with no return can lead to charges. Also if NARA suspects you have them and demands them to be returned you must locate and return them. If you do not and they are found by NARA (FBI) you will be charged.
So the reason Biden and Pence were not charged was because as soon as they found them, they returned them. When asked if FBI could search and ensure no more were present, they opened their doors and let them search. Unlike Trump who fought them at every stage.
- He lied about having more when he knew he did. (THAT is a crime that gets charged)
- When that lead to subpoena he lied to his lawyer to swear a statement, affidavit, they had no more (THAT is a crime that gets charged and gets your lawyer sanctioned)
- when that lead to a search warrant, he and co conspirators set about hiding and moving doc's to try and make sure they would not be found (THAT is a serious crime that gets charged).
So Trump is in now way getting charged for the 'same' thing Biden and Pence did and that is just a lie his supporters tell. Just as they are not crafting the same lie that Al Gore did the same Trump did, in his election loss to GBJr when that is not the case, even remotely.

The word TRANSFER there refers to the return of physical custody and all rights to the documents being RETURNED to the Archive the day the prior ceases to be POTUS anymore.
