The problem with you as a foil, Earl, which is all you are, is you're too easy. The question was why would Harvard as a private university be subject to the ruling and the answer is that any university that accepts public funds, and Harvard does accept them,
is subject to Title VI. The court's precedent would not apply to Harvard otherwise. That question of law was the sum total of the post and answer.

Almost all universities accept some form of public funds and those that don’t would be committing an act of open racism if they used race as a part of the entrance requirements.

No, most ethical people would not admit an unqualified student despite the amount of money Fred Trump donated to them.

Rather than looking at race, why not award "points" (or whatever they call their systems) based on h.s. academic achievement (#1), economic status of the applicant's high school with points going to a student from less affluent areas with rural or urban, major/area of study (is it in a field that is likely to be in demand, like STEM?).

Agreed. A meritocracy is best.

Even better, IMO, is to maximize the education of all Americans K-12....which is what We, the People, should have been doing all along but haven't. Only 8% of school funding is Federal. The remaining 92% is local. Poor counties and poor states produce poor students. Giving a poor student a free ride at community college isn't the solution.

First, it depends upon the funds and the purpose. If Harvard has a federal grant for medical research, does that apply to the Harvard School of Business or Law?

If you take a dime from the Federal government in support for a medical condition, does this allow them to dictate your life? Search your home? Of course not. That'd be fucking stupid.

Their choice, but I think American taxpayers will benefit most from better educated HS students instead of only focusing upon college students....which is the current DNC mantra.

When I was a prosecutor and someone turned themselves in for an economic crime, paid back the money plus fines and interest, if they had no criminal record… we let them plea guilty so its on their record and let them off the hook.
