1. should police officers wait until they are actually fired upon before shooting back? or is the raised weapon enough to justify self defense?

There is evidence that he did reconnaissance on Neely’s movements and followed him into the subway with the intent of murdering him.
Also, considering that Neely was black and Penny white, this was a hate crime. Premeditated hate crime.

They include four for alleged assault, while others involved accusations of transit fraud and criminal trespass. At the time of his death, Neely had one active warrant for an alleged assault in connection with a 2021 incident.
Many of Neely's arrests were for alleged violations of local law, the spokesperson said, and involved lower-level offenses such as having an open container of alcohol in public.
“Neely's family says he suffered from mental illness, which started at age 14 after his mother was murdered. NYPD sources say police had more than a dozen encounters with him over the years in which he appeared to be suffering mental health problems. There are around 57 million mentally ill people in the United States but most don’t go around attacking people and threatening to kill them.
Neely was a violent criminal who has an extensive record and threatened people on a train with violence
You can’t tell the difference which is why you always need to use the same amount of force.

The state of NY were fully aware of his mental condition but chose to let him out on the streets after 43 arrests and 4 convictions for assaults
